2023 PartSource VIP WEEKEND Contest 

OFFICIAL CONTEST RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER ORWIN THIS CONTEST. A PURCHASE OR PAYMENT WILL NOT INCREASE OR IMPROVE YOUR CHANCESOF WINNING. VOID WHERE PROHIBITED BY LAW. INTERNET ACCESS REQUIRED.


WINNERS MAY BE REQUIRED TO PARTICIPATE IN THE PRIZEFULFILLMENT PROCESS AND SIGN DOCUMENTATION, SUCH AS A RELEASE, WITHIN THREE (3)BUSINESS DAYS, AS MORE FULLY DETAILED BELOW.


BY ENTERING THE CONTEST, YOU AGREE TO THESE OFFICIAL RULES,WHICH ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. WITHOUTLIMITATION, THIS CONTRACT INCLUDES INDEMNITIES TO THE SPONSOR (DEFINED BELOW)FROM YOU AND A LIMITATION OF YOUR RIGHTS AND REMEDIES.


The PartSource VIP Weekend Contest (the “Contest”) isintended to be conducted only in the provinces of Alberta, Saskatchewan,Manitoba, Ontario and Nova Scotia and shall be construed and evaluatedaccording to applicable Canadian law. No purchase necessary. Participants mustbe of the age of majority in their province or territory of residence or olderat the time of entry. Void in whole or part where prohibited by law. Entry inthis Contest constitutes acceptance of these Contest rules (the “ContestRules”).


1. SPONSOR: The Contest sponsor and administrator isPartSource, a division of Canadian Tire Corporation, Limited (the “Sponsor”)with its head office located at 336 Courtland Avenue, Vaughan, Ontario L4K 4Y1.This Contest is also administered by the Sponsor. This Contest is in no waysponsored, administered, endorsed by or associated with Meta Platforms, Inc. (“Facebook”).Any questions, comments or complaints must be directed to the Sponsor, and notto Facebook.


2. ELIGIBILITY. To be eligible for this Contest, anindividual must:

(a) be a legal resident of Alberta, Saskatchewan, Manitoba,Ontario and Nova Scotia;

(b) have a valid email address; and

(c) be of the age of majority in their province or territoryof residence or older at the time of entry.

Employees of the Sponsor, its affiliates, subsidiaries,related companies, advertising and promotional agencies, and the immediatefamily members (i.e., parents, spouses, siblings, children, grandparents, stepparents, step children and step siblings, and their respective spouses, andthose living in the same household, whether or not related) of any of theabove, are not eligible to participate in the Contest.


The Sponsor shall have the right at any time to requireproof of identity and/or eligibility to participate in the Contest. Failure toprovide such proof may result in disqualification. All personal and otherinformation requested by and supplied to the Sponsor for the purpose of theContest must be truthful, complete, accurate and in no way misleading. TheSponsor reserves the right, in its sole discretion; to disqualify any entrantshould such an entrant at any stage supply untruthful, incomplete, inaccurateor misleading personal details and/or information.


3. CONTEST PERIOD. The Contest begins on Friday, April 28,2023 at 9:00 a.m. Eastern Time (“ET”) and ends on Wednesday, July 19, 2023 at11:59 p.m. ET (the “Contest Period”) after which time the Contest will beclosed and no further entries shall be accepted.


4. HOW TO ENTER.


(a) There is no purchase necessary to enter the Contest.Enter using the method of entry outlined below. No entries will be accepted byany other means.


(i) To enter, entrants must visithttp://partsource.ca/VIPweekend (the “Contest Website”);


(ii) Complete each of the required fields contained in theContest registration form;


(iii) Provide express consent to opt-in to receiveelectronic marketing communications about offers, products and services andother electronic messaging from PartSource, as well as from their otheraffiliates and/or marketing partners; and


(iv) Submit the Contest registration form to receive


(a) entry (each an “Entry”, collectivelythe “Entries”).


(b) Each entrant is eligible toreceive one (1) Entry into the Contest during the Contest Period. Creation anduse of multiple or alias email accounts in order to exceed the limits onEntries permitted by these Contest Rules may result in the disqualification ofall Entries from such accounts as well as disqualification of the entrant fromthe Contest.


(c) In the event of a disputeregarding who submitted an Entry, the authorized subscriber of the emailaccount used to participate in the Contest at the time of entry will be deemedto be the entrant. The authorized account subscriber is defined as the naturalperson who is assigned an email account that can be verified by Sponsor. Forfurther clarity, for the purpose of the Contest Rules, “authorized accountsubscriber” of a valid email account is defined as the natural person who isassigned an email address by an internet access provider, on-line serviceprovider, or other organization responsible for assigning email addresses forthe domain associated with the email address. Each winner may be required toprovide the Sponsor with proof that the winner is the authorized account holderof the email address that is associated with the winning Entry.


(d) By participating in thisContest, entrant acknowledges, represents and warrants that:


(i) the Entrydoes not contain any material that is libelous, defamatory, profane or obsceneand does not violate any laws relating to hate speech or otherwise;


(ii) the Entryis an original Entry, solely created by the entrant , and that no third partyparticipated as an author, coauthor, photographer or otherwise in the creationof the Entry or any part thereof and that all right, title, and interest(including copyright) therein and thereto and is owned and/or controlled by theentrant to the full extent necessary to enable the Sponsor to use the Entry ascontemplated by these Contest Rules;


(iii) theEntry does not infringe upon the intellectual property or other statutory orcommon law rights of any third party; and (iv) if applicable, any minor shownin the Entry and the submission of the Entry is made with the consent of aparent and/or legal guardian of such minor.


(e) You agree that the Sponsor may, at any time, edit,modify or remove the Entry, in whole or in part, and may disqualify an entrantfrom the Contest if the Sponsor believes, in its sole discretion, that theentrant has breached any of the representations and warranties made aboveincluding, without limitation, on the basis of concerns relating to the rightsof third parties, including but not limited to privacy, copyright, defamation,rights of personality, obscenity or hate speech.


(f) Upon request by the Sponsor, the entrant agrees that itshall sign (or cause to be signed) all further documents or do (or cause to bedone) all further acts and provide all reasonable assurances as many reasonablybe necessary or desirable to give effect to the assignment of the entrant’srights in the Entry.


(g) Entries must be received no later than the end of theContest Period. Entries will be declared invalid if they are late, illegible,incomplete, damaged, irregular, mutilated, forged, garbled or mechanically orelectronically reproduced. No communication or correspondence will be exchangedwith entrants except with those selected for a Prize.


5. PRIZES.


(a) Secondary Prizes: There are three (3) secondary prizes(each a “Secondary Prize”) available to be won during the Contest Period. One(1) Secondary Prize in May, one (1) Secondary Prize in June and one (1)Secondary Prize in July (further details below). Each Secondary Prize consistsof a Simoniz 2100 PSI Electric Pressure Washer (039-8065) provided by theSponsor, each with an approximate retail value (ARV) of three hundred andninety-nine dollars and ninety-nine cents ($399.99 CAD).


(b) Grand Prize: There is one (1) grand prize (the “GrandPrize”) available to be won during the Contest Period. The Grand Prize is afour (4) day and three (3) night trip for the winner (the “Winner”) and one (1)adult companion (the “Guest”) to a PartSource VIP Weekend experience providedby the Sponsor. The total approximate value of the Grand Prize is five thousandfive hundred dollars ($5,500 CAD) based upon a return flight from Edmonton, Alberta.The Winner will be able to choose one (1) of the following packages, whichshall include:


Option 1: Explore Toronto


(i) round-trip economy airfare for the Winner and his/herGuest on an air carrier selected by the Sponsor from the major airport closestto the Winner’s residence to Toronto, Ontario;


(ii) round-trip ground transportation for the Winner andGuest between the airport and hotel in Toronto, Ontario, between the hotel anddowntown Toronto and between the hotel and Canadian Tire Motorsport Park inBowmanville, Ontario;


(iii) three (3) nights’ accommodation (double occupancy) ina hotel to be selected by Sponsor;


(iv) two (2) tickets to Ripley’s Aquarium;


(v) two (2) tickets to the CN Tower;


(vi) two (2) tickets to a live theatre production onSeptember 2, 2023;


(vii) approximately $340.00 CAD pre-paid credit card formeals and spending money.

Value will fluctuate based on the roundtrip airfare from thewinner’s residency;


(viii) two (2) tickets to the Labour Day Weekend Sprints atCanadian Tire Motorsport Park on September 3, 2023.

OR

Option 2: Weekend at Canadian Tire Motorsport Park:


(i) round-trip economy airfare for the Winner and his/herGuest on an air carrier selected by the Sponsor from the major airport closestto the Winner’s residence to Toronto, Ontario;


(ii) round-trip ground transportation for the Winner andGuest between the airport and hotel in Toronto, between the hotel and downtownToronto Ontario, and between the hotel and Canadian Tire Motorsport Park inBowmanville, Ontario;


(iii) three (3) nights’ accommodation (double occupancy) ina hotel to be selected by

Sponsor;


(iv) approximately 865.00 CAD pre-paid credit card for mealsand spending money. Value will fluctuate based on the roundtrip airfare fromthe winner’s residency


(v) two (2) tickets to the Labour Day Weekend Sprints atCanadian Tire Motorsport Park on September 2 and 3, 2023


The Grand Prize does not include goods or services that arenot specified above. Goods and services NOT covered by the Grand Prize include,but are not limited to, transportation to and from originating airport,insurance of any nature, travel documentation, airport improvement fees, taxes,gratuities, telephone calls, meals not specifically mentioned above, anyalcoholic beverages, unscheduled transportation to or from any location, roomservice/in-room charges, room upgrades, laundry/dry cleaning, cancellationpenalties, if any, and any other expense not explicitly included in the GrandPrize.


(c) Grand Prize Winner and Guest must be available to travelon and between September 1, 2023 and September 4, 2023. Should the Grand PrizeWinner and Guest be unable to travel on the dates and times designated, theGrand Prize will be forfeited and awarded to an alternate winner. It is theresponsibility of the Grand Prize Winner and Guest to obtain all necessarytravel documents. The Guest must be of the age of majority in the province orterritory of their residence. Reservations are subject to availability of bothair and hotel at the time of booking. All bookings are subject to 100%cancellation penalties.


(d) Each Secondary Prize Winner is not entitled to monetarydifference between actual Secondary Prize value and stated approximateSecondary Prize value, if any.


(e) The Grand Prize Winner is not entitled to monetarydifference between actual Grand Prize value and stated approximate Grand Prizevalue, if any.


(f) Each Secondary Prize will be distributed within ten (10)business days after each Secondary Prize Winner has been successfullycontacted, notified of his/her Secondary Prize and fulfilled the requirementsset out herein.


(g) Each prize must be accepted as awarded and cannot betransferred, assigned, substituted or redeemed for cash, except at the solediscretion of the Sponsor. Any unused portion of a Secondary Prize or the GrandPrize will be forfeited and have no cash value. The Sponsor reserves the right,in its and its sole discretion, to substitute a prize of equal or greater valueif a Secondary Prize or the Grand Prize (or any portion thereof) cannot beawarded for any reason.


(h) The Sponsor shall not assume any liability for a lost,damaged or misdirected Secondary Prize and/or Grand Prize.


6. GRAND PRIZE WINNER SELECTION.

There will be one (1) winner (a “Grand Prize Winner”)selected from all of the eligible Entries submitted during the Contest Period,and will be conducted as follows:


(a) On July 20, 2023 at approximately 11:00 a.m. ET at thePartSource Store Support Centre located at 336 Courtland Avenue in Vaughan,Ontario, one (1) entrant will be selected by a random electronic draw by arepresentative of the Sponsor following a review of eligible Entries receivedduring the Contest Period. The odds of being selected as a potential winner aredependent upon the number of eligible Entries received by the Sponsor. Beforebeing declared a Grand Prize Winner, the selected entrant shall be required to:(i) correctly answer, without assistance of any kind, whether mechanical orotherwise, a time-limited mathematical skill-testing question to beadministered during a pre-arranged telephone call or by email, (ii) comply withthe Contest Rules, and (iii) sign and return the Confirmation and Release(described below).


(b) The selected entrant will be notified by email no laterthan 4:00 p.m. ET on July 20, 2023.

The Sponsor will make a minimum of three (3) attempts tocontact the selected entrant within five (5) business days of the draw date.Upon notification, the selected entrant must provide required information incompliance with these Contest Rules to the email provided in the notification,and the selected entrant’s response must be received in three (3) business days.If the selected entrant does not respond in accordance with the Contest Rules,he/she will be disqualified and will not receive the Grand Prize and anotherentrant may be

selected, in the Sponsor’s sole discretion, until such timeas an entrant satisfies the terms set out herein. The Sponsor is notresponsible for the failure for any reason whatsoever of a selected entrant toreceive notification or for the Sponsor to receive a selected entrant’s response.


(c) If, as a result of an error relating to the entryprocess, drawing or any other aspect of the Contest, there are more selectedentrants for the Grand Prize than contemplated in these Contest Rules, therewill be a random draw amongst all eligible Grand Prize claimants after theContest’s closing date to award the correct Grand Prize.


(d) ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BYSPONSOR OR ADMINISTRATOR, WHOSE DECISIONS ARE FINAL. AN ENTRANT IS NOT A WINNEROF ANY PRIZE, EVEN IF THE CONTEST SHOULD SO INDICATE, UNLESS AND UNTILENTRANTS’ ELIGIBILITY AND THE POTENTIAL WINNING ENTRY HAS BEEN VERIFIED ANDENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOTACCEPT OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS.


7. SECONDARY PRIZE WINNER SELECTION.

There will be a total of three (3) secondary prize winners(each a “Secondary Prize Winner”) selected from all of the eligible Entriessubmitted, and will be conducted as follows: (a) On May 30, 2023, June 30 2023,and July 20, 2023 at approximately 11:00 a.m. ET (each a “Draw Date”) at thePartSource Store Support Centre located at 336 Courtland Avenue in Vaughan,Ontario, one (1) entrant will be selected on each respective Draw Date by a randomelectronic draw by a representative of the Sponsor following a review ofeligible Entries received. The eligible Entries for each Draw Date will includeall eligible Entries received from the start of the Contest up to and includingthe respective Draw Date. The odds of being selected as a potential winner aredependent upon the number of eligible Entries received by the Sponsor for eachrespective time period before each Draw Date. Before being declared a SecondaryPrize Winner, each selected entrant shall be required to:


(i) correctly answer, without assistance of any kind,whether mechanical or otherwise, a time-limited mathematical skill-testingquestion to be administered during a pre-arranged telephone call or by email, 


(ii)comply with the Contest Rules, and (iii) sign and return the Confirmation andRelease (described below).


(b) Each selected entrant will be notified by email no laterthan 4:00 p.m. ET on each respective Draw Date. The Sponsor will make a minimumof three (3) attempts to contact the selected entrant within five (5) businessdays of each respective Draw Date. Upon notification, the selected entrant mustprovide required information in compliance with these Contest Rules to theemail provided in the notification, and the selected entrant’s response must bereceived in three (3) business days. If the selected entrant does not respondin accordance with the Contest Rules, he/she will be disqualified and will notreceive the Secondary Prize and another entrant may be selected, in theSponsor’s sole discretion, until such time as an entrant satisfies the termsset out herein. The Sponsor is not responsible for the failure for any reasonwhatsoever of a selected entrant to receive notification or for the Sponsor to receivea selected entrant’s response.


(c) If, as a result of an error relating to the entryprocess, drawing or any other aspect of the Contest, there are more selectedentrants for the Secondary Prize than contemplated in these Contest Rules,there will be a random draw amongst all eligible Secondary Prize claimantsafter the Contest’s closing date to award the correct Secondary Prizes.


(d) ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BYSPONSOR OR ADMINISTRATOR, WHOSE DECISIONS ARE FINAL. AN ENTRANT IS NOT A WINNEROF ANY PRIZE, EVEN IF THE CONTEST SHOULD SO INDICATE, UNLESS AND UNTILENTRANT’S ELIGIBILITY AND THE POTENTIAL WINNING ENTRY HAS BEEN VERIFIED ANDENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOTACCEPT OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS.


8. RELEASE. The Grand Prize Winner and Guest, and eachSecondary Prize Winner will be required to execute a release and waiver(“Confirmation and Release”) that confirms: (i) eligibility for the Contest andcompliance with these Contest Rules; (ii) acceptance of the respective prize asoffered; (iii) release of the of the Sponsor, Administrator, Facebook., andeach of their subsidiaries, affiliates and/or related companies and each oftheir employees, directors, and officers, advertising and promotional agenciesinvolved in this Contest as well as the prize sponsors (collectively, the “Releasees”)from any and all liability for any loss, harm, damages, cost or expense arisingout of participation in the Contest, participation in any Contest-relatedactivity or the acceptance, use, or misuse of any Grand Prize or SecondaryPrize, including but not limited to costs, injuries, losses related to personalinjuries, death, damage to, loss or destruction of property, rights ofpublicity or privacy, defamation, or portrayal in a false light, or from anyand all claims of third parties arising therefrom; (iv) grant to the Sponsorthe unrestricted right, in the Sponsor’s individual discretion, to produce,reproduce, publish, broadcast, communicate by telecommunication, exhibit,distribute, adapt and otherwise use or re-use the winner’s name, photograph, theEntry, likeness, voice and biography, in any and all media now known orhereafter devised, in connection with the Contest and the promotion andexploitation thereof; (v) assignment to the Sponsor all of each winner’s right,title and interest, including copyright in and to the Entry, throughout theworld in perpetuity and acknowledgment that, as a result of this assignment,the Sponsor will have the exclusive and perpetual right to exploit the Entry inany media now known or later developed in whatever ways the Sponsor maydetermine in its sole discretion and to authorize others to do so, includingwithout limitation, the right to reproduce, distribute, publish, exploit,display, communicate to the public by telecommunication, transmit, broadcastand otherwise use and exploit the Entry, in whole or in part and to edit, addto, or modify the Entry in any way, all without further obligation or compensationof any kind to each winner; (vi) waiver of all of each winner’s so-called“moral rights” that it may enjoy now or in the future in any territorythroughout the world in relation to the Entry, to the maximum extent permittedby law; and (vii) acknowledgement that, upon request by the Sponsor, eachwinner shall sign (or cause to be signed) all further documents or do (or causeto be done) all further acts and provide all reasonable assurances as mayreasonably be necessary or desirable to give effect to the assignment of eachwinner’s rights in the Entry. The executed Confirmation and Release must bereturned within three (3) business days of the verification as each winner orthe selected entrant will be disqualified and the respective prize forfeited.


9. INDEMNIFICATION BY ENTRANT. By entering the Contest,entrant releases and holds Releasees harmless from any and all liability forany losses, harm, damages, costs or expenses of any kind to the entrant or anyother person, including but not limited to, personal injury, death, damage to,loss or destruction of property damage, rights of publicity or privacy,defamation, portrayal in a false light and third party claims resulting inwhole or in part, directly or indirectly, from participation in the Contest,participation in any Contest related activity or the acceptance, possession,use or misuse of any prize, or any breach of the Contest Rules, or in anyprize-related activity.


10. LIMITATION OF LIABILITY. The Sponsor assumes noresponsibility or liability for:


(a) lost, late, unintelligible/illegible, falsified,damaged, misdirected or incomplete Entries, notifications,responses, replies orany Confirmation and Release,


(b) any computer, online, software, telephone, hardware ortechnical malfunctions that may occur, including but not limited tomalfunctions that may affect the transmission or non-transmission of an Entry,


(c) any incorrect or inaccurate information, whether causedby website users or by any of the equipment or programming associated with orutilized in the Contest or by any technical or human error which may occur in theadministration of the Contest,


(d) any error, omission, interruption, deletion, defect,delay in operation or transmission, communications line failure, theft ordestruction or unauthorized access to, or alteration of, Entries,


(e) any problems, failures or technical malfunction of anytelephone network or lines, computer online systems, servers, providers,computer equipment, software, email, players, or browsers, on account oftechnical problems or traffic congestion on the Internet, at any website, or onaccount of any combination of the foregoing,


(f) any injury or damage to entrant or to any computerrelated to or resulting from participating or downloading materials in thisContest or by the acceptance, possession, use, misuse of, or failure to receiveany prize. The Sponsor assumes no responsibility or liability in the event thatthe Contest cannot be conducted as planned for any reason, including thosereasons beyond the control of the Sponsor, such as infection by computer virus,bugs, tampering, unauthorized intervention, fraud, technical failures, or corruptionof the administration, security, fairness, integrity or proper conduct of thisContest or the Contest Website.


11. CONDUCT. By participating in the Contest, each entrantagrees to be bound by the Contest Rules, which will be made available online atwww.partsource.ca/readysetsignup. Entrant further agrees to be bound by thedecisions of the Sponsor, which shall be final and binding in all respects. TheSponsor reserves the right, in its sole discretion, to disqualify any entrantfound to be:


(a) violating the Contest Rules; 

(b) tampering or attemptingto tamper with the entry process or the operation of the Contest; 

(c) violatingthe terms of service, conditions of use and/or general rules or guidelines ofany online PartSource property or service; and/or 

(d) acting in anunsportsmanlike or disruptive manner, or with intent to annoy, abuse, threatenor harass any other person. Caution: Any attempt to deliberately undermine thelegitimate operation of the Contest may be a violation of criminal and civillaws. Should such an attempt be made, the Sponsor reserves the right to seekremedies and damages to the fullest extent permitted by law, including but notlimited to criminal prosecution.


12. PRIVACY / USE OF PERSONAL INFORMATION.


(a) By participating in the Contest, entrant : (i) grants tothe Sponsor the right to use his/her name, mailing address, the Entry,telephone number, and e-mail address (“Personal Information”) for the purposeof administering the Contest, including but not limited to contacting andannouncing the winners; (ii) grants to the Sponsor the right to use his/her PersonalInformation for administrative, publicity, and promotional purposes relating tothe Contest, in any and all media now known or hereafter devised, withoutfurther compensation unless prohibited by law; and (iii) acknowledges that theSponsor may disclose his/her Personal Information to third-party agents andservice providers of the

Sponsor in connection with any of the activities listed in(i) and (ii) above.


(b) The Sponsor will use the entrant’s Personal Informationonly for identified purposes, and protect the entrant’s Personal Information ina manner that is consistent with the Canadian Tire Corporation, Limited (“CTC”)Privacy Policy at: http://www.canadiantire.ca/en/customer-service/privacy-policy.htmlCTC’s Privacy Policy not only outlines its commitment to safeguarding Personal Information,but it also details how to opt-out of receiving marketing communications.


13. INTELLECTUAL PROPERTY. All intellectual property,including but not limited to trademarks, trade names, logos, designs,copyrights and any other intellectual property and trade secrets contained inany materials, including without limitation, print, digital and any other mediais owned by the Sponsor and/or their affiliates, unless otherwise stated. Allrights are reserved. Unauthorized copying or other use of any such materialwithout the express written consent of its owner is strictly prohibited.Canadian Tire name, logos and marks are owned by Canadian Tire Corporation,Limited.


14. TERMINATION. The Sponsor reserves the right, in its solediscretion, to terminate the Contest, in whole or in part, and/or to modify,amend or suspend the Contest, and/or the Contest Rules in any way, at any time,for any reason without prior notice.


15. LAW. These are the official Contest Rules. The Contestis subject to applicable federal, provincial and municipal laws andregulations. The Contest Rules are subject to change without notice in order tocomply with any applicable federal, provincial and municipal laws or the policyof any other entity having jurisdiction over the Sponsor. All issues andquestions concerning the construction, validity, interpretation andenforceability of the Contest Rules or the rights and obligations as betweenthe entrant and the Sponsor in connection with the Contest shall be governed byand construed in accordance with the laws of the province of Ontario includingprocedural provisions without giving effect to any choice of law or conflict oflaw rules or provisions that would cause the application of any otherjurisdiction’s laws. FURTHER, IN ANY SUCH DISPUTE, UNDER NO CIRCUMSTANCES WILLAN ENTRANT BE PERMITTED OR ENTITLED TO OBTAIN (AND HEREBY WAIVES ALL RIGHTS TOSEEK OR CLAIM) INJUNCTIVE, EQUITABLE, OR OTHER NON-MONETARY RELIEF OR AWARDSFOR PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES,INCLUDING LAWYERS’ FEES, OTHER THAN ENTRANT’S ACTUAL OUTOF-POCKET EXPENSES (IFANY), NOT TO EXCEED TEN DOLLARS ($10), AND ENTRANT FURTHER WAIVES ALL RIGHTS TOHAVE DAMAGES MULTIPLIED OR INCREASED


16. LANGUAGE DISCREPANCY. In the event of any discrepancy orinconsistency between the terms and conditions of the Contest Rules anddisclosures or other statements contained in any Contest-related materials,including but not limited to the Contest entry form, or point of sale, television,print or online advertising, the terms and conditions of the Contest Rules shallprevail.


17. SEVERABILITY. If any term or condition of the ContestRules is invalid, illegal or unenforceable in any jurisdiction, suchinvalidity, illegality or unenforceability shall not affect any other term or provisionof the Contest Rules.
